The agreement
These terms are an agreement between you and Motiondetection, the operator of motiondetection.com, referred to below as we, us or the service. By using this website, running the demo, or subscribing to a paid plan, you accept them. If you are accepting on behalf of a company, you confirm you are allowed to do so and the agreement is with that company.
Our privacy policy forms part of this agreement and explains what personal data we handle.
What the service is
Motiondetection is video analytics software. It reads video from cameras you own or from clips you provide, detects motion, classifies detected events into categories such as person, vehicle, animal or package, and delivers those events to you as a timeline and as alerts. It is a supplement to your existing cameras and recorder, not a replacement for either, and it is not a monitoring service: nobody at Motiondetection watches your footage or responds to your alerts on your behalf.
The service does not perform facial recognition, does not compute or store face templates or other biometric identifiers, and does not re-identify individuals across cameras or across time. That is a property of the product, described more fully on the security page.
The demo
The demo on this website is free, requires no account, and is provided so you can judge the detection quality for yourself. It runs the detection stage in your own browser. As set out in the privacy policy, small still crops around detected events are transmitted for classification; the video itself is not. Do not upload footage you are not entitled to process, and do not use the demo to process footage of people who have not been informed that cameras are operating.
The demo is provided as is, with no availability commitment, and we may change or withdraw it.
Signing up
Signing up on this site means giving an email address and confirming it with a six digit code. That is the whole process, and it does not create a paid subscription, a charge, or an obligation on you. Keep the address current, and do not sign up with an address you do not control.
Acceptable use
You agree not to:
- Use the service to process video you have no lawful right to process.
- Attempt to derive, reconstruct or infer the identity of individuals from the service's output, or combine its output with other systems in order to do so.
- Resell, sublicense or provide the service to third parties as your own, unless we have agreed that in writing.
- Probe, scan or attack the service's infrastructure, or attempt to circumvent rate limits, tier limits or access controls.
- Upload malware, or content that is unlawful in the jurisdiction where you are using the service.
- Use the service where its failure could cause death, personal injury or severe environmental damage. It is not certified for life safety use, and it is not a fire, intrusion or life safety alarm system.
Lawful surveillance is your responsibility
You are the operator of your cameras and the controller of the footage they produce. Signage, notice, employee consultation, recording in private areas, retention limits and every other obligation that attaches to running cameras remain yours. We provide software that reads a stream you already have, and nothing in this agreement transfers those duties to us or means we have assessed your deployment.
Plans, billing and cancellation
Paid plans are described on the pricing page, which forms part of these terms as to price, camera counts and what each tier includes. There is no free plan. Prices are in US dollars and exclusive of any sales tax or VAT, which is added where it applies.
Monthly plans renew monthly and can be cancelled at any time, effective at the end of the paid month. Annual plans are for a year, at the published annual rate, and renew annually unless cancelled before the renewal date. Enterprise terms are set out in a separate written agreement, which takes precedence over this section where the two differ.
We may change prices with 30 days notice by email, effective at your next renewal. If a price rise is not acceptable, cancel before that renewal and you are not charged the new rate.
Your footage and your data
Your footage is yours. You keep all rights in it, and we claim none. We do not use your footage, your event data or your crops to train models, and we do not disclose them to anyone except the processors listed in the privacy policy, each of which acts on our instructions for one specific job.
You grant us the limited licence needed to actually run the service: to process the video and crops you send it, produce events from them, and deliver those events to you. That licence exists for no other purpose and ends when your use does.
Availability and support
We aim to keep the service running and will tell you about planned maintenance, but outside an Enterprise agreement there is no service level commitment, no uptime guarantee and no credit regime. Support is by email at the response times published on the pricing page for your tier.
Intellectual property
The service, this website, and everything in them other than your own content belong to us. You get a non exclusive, non transferable right to use the service while your subscription is current, for your own business purposes. Nothing here transfers ownership of anything.
Warranties and what they do not cover
The service is provided as is. We do not warrant that detection will find every event, that classification will always be correct, or that alerts will always be delivered. Video analytics is probabilistic: conditions such as heavy rain on a lens, near total darkness, or a subject mostly outside the frame reduce accuracy, and those limits are described openly on the how it works page rather than buried here.
Do not use this as your only safeguard for anything that matters. It reduces the review burden on cameras you already run; it does not replace physical security, alarms, insurance or human judgement.
Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential loss, or for lost profits, lost revenue, lost goodwill or lost data, however caused. Our total liability arising out of or connected with this agreement is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing in this agreement limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow some of these exclusions, in which case they apply to you only to the extent permitted.
Suspension and termination
You can stop using the service at any time and cancel as described above. We may suspend or terminate access if you materially breach these terms, if payment fails and is not resolved, or if we are required to by law. Where the reason is fixable, we will tell you and give you a reasonable chance to fix it before suspending.
On termination, processing stops and event history is deleted on the retention schedule for your tier. Your footage is unaffected, because it was never held by us.
Changes to these terms
We may update these terms. If a change is material, the date at the top of this page changes and anyone with a confirmed email address is told by email at least 30 days before it takes effect. Continuing to use the service after that date means you accept the updated terms.
